Terms and Conditions for Explore Southern Africa Self Drive Safaris in Southern Africa
- Introduction
These Terms and Conditions (“Agreement”) govern the relationship between you, the customer (“Customer” or “You”), and Explore Southern Africa (“We,” “Us,” or “Our”) for the provision of guided self-drive safaris through Southern Africa. By booking or participating in a safari with us, you agree to these Terms and Conditions.
- Booking and Payment
- Booking Process: To confirm your booking, a deposit of 10% of the total safari cost is required at the time of booking. Full payment must be made no later than 21 days prior to the departure date.
- Payment Methods: Payments can be made via:
- EFT Deposit
- Monthly instalments
- Cash.
- Currency: All payments must be made in Rands or US Dollar.
- Booking Confirmation: Your safari booking is only confirmed upon receipt of the deposit and our written confirmation. We reserve the right to refuse any booking at our discretion.
- Price and Inclusions
- Safari Costs: The price of the safari includes the following:
- Guided self-drive safari experience.
- Accommodation and meals as specified in the itinerary (Please ensure you understand the package).
- Guided tours and activities included in the package. (Please make sure you understand what is included and excluded)
- Exclusions: The safari cost does not include:
- Personal expenses (e.g., souvenirs, optional activities).
- Travel insurance (which is mandatory).
- Visa fees, vaccinations, or travel documents.
- Any other items not specifically mentioned in the itinerary.
- Vehicle insurance, fuel, and necessary permits.
- Vehicle and Equipment(Optional Extra)
- Vehicle Rental: The vehicle provided for the safari is for the exclusive use of the Customer during the safari period. The Customer must adhere to all vehicle usage guidelines and road safety regulations.
- Damage or Loss: The Customer is responsible for the vehicle’s condition during the safari and agrees to reimburse Us for any damage, loss, or theft of the vehicle or its equipment, regardless of fault.
- Insurance: The vehicle is covered by insurance. However, the Customer is liable for the insurance excess amount (deductible) in the event of damage or loss. We recommend taking out additional insurance to cover this excess.
- Health and Safety
- Medical Requirements: It is the Customer’s responsibility to ensure they are medically fit for travel. If you have any pre-existing medical conditions or require special assistance, you must inform Us at the time of booking.
- Travel Insurance: Each traveller must arrange their own travel insurance and medical coverage.
- Safety Protocols: You agree to follow all safety instructions given by the guide, including vehicle operation, wildlife encounters, and other safety measures. We reserve the right to remove any Customer from the safari who disregards safety rules.
- Cancellation and Amendments
- Customer Cancellations:
- If you cancel your booking more than 30 days before the departure date, we will refund 30% of the total cost (If fully paid).
- If you cancel within 21 days of departure, no refund will be provided.
- Our cancellations: We reserve the right to cancel or modify the safari itinerary due to unforeseen circumstances (e.g., natural disasters, political instability, or other emergencies). In such cases, we will offer the option to reschedule.
- Amendments: Any changes to your booking are subject to availability and may incur additional fees. All amendment requests must be submitted in writing.
- Responsibilities and Conduct
- Customer’s Responsibilities:
- You agree to behave responsibly and respectfully towards other participants, the guide, and the environment.
- You are responsible for the actions and behaviour of any minors, or third parties included in your booking.
- You must adhere to all local laws and regulations, including wildlife protection laws.
- Guides’ Role: Our guides will provide expert advice and assistance throughout the safari. However, we cannot guarantee the appearance of specific wildlife or the success of activities.
- Liability
- General Liability: We will not be held liable for any direct or indirect losses, damages, injuries, or death arising from participation in the safari, except where such liability is mandated by law.
- Force Majeure: We will not be held responsible for any delay, changes, or cancellations due to circumstances beyond our control, including but not limited to natural disasters, strikes, or government restrictions.
- Photography and Media
- You consent to the use of photographs, videos, or other media taken during the safari for promotional purposes by Us unless you inform Us otherwise in writing prior to the safari.
- Any personal photographs taken during the safari are for personal use only and may not be used commercially without prior permission from Us.
- Governing Law and Disputes
This Agreement is governed by the laws of The Republic of South Africa, Gauteng, Any disputes arising from this Agreement will be resolved through binding arbitration in Pretoria South Africa.
- Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remainder will continue in full force and effect.
- Acceptance of Terms
By booking a guided self-drive safari with Explore Southern Africa, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
